Finkelstein www.kll-law.com Financial review is a legitimate require- ment for purchasers, but rejection for non- fi nancial reasons can bring serious repercus- sions. Koplovitz notes that even asking for the age of an applicant is ill advised, since that question can be viewed as a possible dis- criminatory factor. Although common on many applications, the question should still be removed. And if sued by the rejected ap- plicant, the board is open to legal discovery, which will expose any negative or discrimi- natory action on its part—even though the board doesn’t have to give a reason for turn- ing down the application. Th e best advice is to play fair. A co-op should be concerned about whether a buyer can aff ord to carry his or her share of the load, not who that person might be. n A J Sidransky is a staff writer/reporter with Th e Cooperator, and a published novelist. VETTING... continued from page 17 Warhol Superstar’s Home Hits the Market An Upper East Side co-op connected to one of famed pop artist Andy Warhol’s associates is on the market, listed for $1.2 million. The New York Post reported that a 1,000-square-foot, one-bedroom apartment where actress/model Edie Sedgwick resided in during the 1960s is now for sale. The co-op on East 63rd Street still has its origi- nal moldings and contains a dressing area, a storage room, and a living room bathed in sunlight. Sedgwick, famed muse of the late artist, died at the age of 28 in 1971. Development Developer Eyes 19-Story Condo Project on UES An application has been filed with New York City’s Department of Buildings (DOB) for the construction of a 19-story condo building on the Upper East Side, according to The Real Deal. Victor Sigoura of Legion Investment Group is spearheading the 145,000 square-foot project that would be built at 109 East 79th Street (the firm had purchased three parcels for the development in 2018 at a price of $62 million). According to the application, the development would bring 36 apartments. Sigoura was a former chief investment officer at Naftali Group before starting Legion. n PULSE continued from page 4
